Terms of use
Last updated: 4 October 2026.
These terms are the agreement between you and the independent developer who makes and operates GradeLab ("the developer", "we") for the GradeLab app and website. By creating an account you accept them. If you do not agree, do not use GradeLab and delete the app.
The service
GradeLab lets a shop record the condition of a used phone with photos, a checklist, a grade and signatures, and share a report of it as a PDF and a public web page. The app runs on the technician's own phone and only photographs the inspected device; it never connects to it.
Who may use it
GradeLab is for businesses. You must be at least 18 and able to enter a contract on behalf of the shop you create or join.
Accounts and shops
- One account is one person. Keep your password private and tell us if you think it is being misused.
- A shop is created by its owner. The owner decides who joins, in which role, and may remove members. Owners are responsible for what the members of their shop do in GradeLab.
- Technicians act on behalf of the shop. Inspections they record belong to the shop, not to the technician, and stay with the shop when the technician leaves.
- The shop's data (its profile, devices, inspections, photos, signatures) is the shop's. We host it and display it as the service requires, and nothing more.
Plans and payment
- Free: a limited number of completed reports per calendar month (five at the time of writing), one person per shop, and a "Made with GradeLab" mark on reports and public pages.
- Shop: a higher number of completed reports per calendar month (two hundred at the time of writing), your own branding, one person per shop.
- Team: everything in Shop, a higher report limit again (seven hundred and fifty at the time of writing), and up to five people per shop.
Paid plans are subscriptions bought by the shop owner through the App Store or Google Play. They renew automatically at the price shown in the store until cancelled in your store account; the store bills you and handles refunds under its own rules. When a plan includes a free trial, the store charges you when the trial ends unless you cancel before. A shop whose subscription lapses goes back to the free plan; its data stays, and completed reports remain readable. Limits are enforced by our servers. Prices may change for new periods with notice through the store, and the report and member limits of any plan may change with notice in the app.
What a report is, and what it is not
A report records what the technician observed and photographed at the time of the inspection, graded by a published rubric, and who signed it. It is the shop's statement, not ours. It is not a warranty, a valuation, a certification or a promise about how the device will work later. The photo hashes let anyone verify that a photo is unchanged since capture; they do not verify what the photo shows. The shop is responsible for the accuracy of its inspections and for what it tells its customers.
Usage statistics
We collect information about how the app is used, such as which features are used and how many inspections and reports are completed, and use it in aggregate for statistics that help us improve GradeLab. The privacy policy describes it. It is never used for advertising and never sold.
Customer data
When a shop records a customer's name, signature or device identifiers, the shop is responsible for having the right to do so and for telling the customer how the record is used. Our privacy policy explains what we store and for how long, and how the shop can delete it.
Your responsibilities
- Your own copies. GradeLab works offline: an inspection lives on the phone that recorded it until that phone syncs. You are responsible for keeping your phones online often enough to sync, for exporting the reports and CSV files you need to keep (the app can share both at any time), and for keeping your own copy of anything you cannot afford to lose. GradeLab is a working tool, not an archive service.
- Your devices and accounts. You are responsible for the security of the phones you install GradeLab on, for who you give access to, for your passwords, and for signing out of shared devices. Anything done through your account or your shop is treated as done by you.
- Your inspections. You are responsible for inspecting carefully, for the accuracy of what you record, for the grade you hand to a customer and for any override you apply, and for complying with the laws that apply to your business, including consumer protection and data protection laws where you operate.
- Your customers. You are responsible for informing your customers that their name, signature and device identifiers are recorded, for having the right to record them, and for handling their requests.
Data loss
To the extent the law allows, we are not liable for the loss, corruption or unavailability of data caused by: a phone that is lost, broken, wiped or replaced before it synced; deleting an account, a shop, an inspection or a draft in the app; a lapsed subscription; unsynced changes at sign-out or at "Erase everything on this phone"; a failure of a third-party service we rely on; or anything outside our reasonable control. We keep server backups for our own recovery only; we do not promise to restore individual records on request.
Security and incidents
We protect the service with reasonable technical and organisational measures: encryption in transit, per-shop access rules enforced in the database, private photo storage with expiring links, hashed passwords and hashed photos. No system is completely secure. To the extent the law allows, we are not liable for unauthorised access, disclosure or loss that results from a compromised phone or account, a public report link that you or your customer shared, a weak or reused password, or an attack that our measures could not reasonably have prevented. If we become aware of a security incident affecting your data we will inform you and the authorities as the law requires, and we will tell you what we know and what to do.
Third-party services
GradeLab depends on services we do not control: our hosting and database provider, the App Store, Google Play, subscription management, email delivery and the networks between them. Their outages, changes or mistakes can affect GradeLab. To the extent the law allows, we are not liable for them. Purchases are made under the store's own terms, and refunds are decided by the store.
Acceptable use
Do not use GradeLab to break the law, to record devices you know to be stolen or to misrepresent a device's condition. Do not try to read another shop's data, probe or overload our systems, scrape public report pages in bulk, or resell the service. Do not upload content you have no right to use, and keep people out of the photos: they are of the device. We may suspend accounts that do.
Availability and changes
The app works offline and syncs when it can. We aim to keep the service available but do not guarantee uninterrupted operation. We may change or add features, and may discontinue the service with at least 60 days' notice, during which you can export your data.
Early features and feedback
Some features may be marked as new, beta or preview. They may change or be withdrawn without the notice period above. If you send us feedback or suggestions, we may use them freely without owing you anything.
Ending the agreement
You can stop using GradeLab and delete your account, your shop or any of your data at any time, from the app, without notice and without giving a reason; the privacy policy describes what is removed and when. We may suspend or end your access if you breach these terms, with notice unless the breach is serious. Sections about reports, liability and governing law survive.
No warranty
The service is provided "as is" and "as available". To the extent the law allows, we make no warranty of any kind, express or implied, including that the service will be uninterrupted, error-free or secure, that data will never be lost, that a grade is correct or fit for a particular purpose, or that a report will be accepted by any buyer, insurer, marketplace or authority. GradeLab is not legal, financial or professional advice.
Limitation of liability
To the extent the law allows:
- We are not liable for indirect, incidental, special, consequential or punitive losses, including lost profits, lost business, lost data, cost of substitute services or reputational harm, even if we were told they were possible.
- We are not liable for the content, accuracy or use of reports, for the grade of a device, for disputes between a shop and its customers or buyers, or for decisions anyone makes on the basis of a report.
- Our total liability to you for all claims together, in contract, tort or otherwise, is limited to the amount you paid us in the twelve months before the claim, or 50 US dollars if you paid nothing.
Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, or mandatory consumer rights where you live.
Indemnity
You will defend and hold us harmless from claims, damages and reasonable costs brought by a third party, including your customers, that arise from your inspections and reports, your breach of these terms, your breach of the law, or content you upload.
App stores
The app is distributed through the Apple App Store and Google Play. Apple and Google are not parties to these terms and have no obligation to you regarding the app, its maintenance or support; those are ours. Your licence to the app is limited, non-transferable and for use on devices you own or control, under the store's usage rules. If the app fails to conform to a warranty that cannot be excluded, you may notify the store for a refund of the purchase price, and the store has no other warranty obligation. Any claim about the app, including product liability, legal compliance and intellectual property, is ours to handle, not the store's. You confirm you are not in a country under a US government embargo or on a US restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these terms for the app on iOS and may enforce them against you.
Trademarks and independence
Apple, iPhone, Samsung, Google, Pixel and the other device names in the app are trademarks of their owners, used only to identify the devices being inspected. GradeLab is independent and is not affiliated with, endorsed by or certified by any device maker, carrier or marketplace.
Data processing for shops
Where a shop uses GradeLab to record data about its customers, the shop is the controller of that data and we process it on the shop's behalf and instructions, which are these terms and the shop's use of the app. We process it only to provide the service, keep it confidential, protect it with the measures described in the privacy policy, use the sub-processors listed there (and give notice before adding one that materially changes the processing), help the shop answer its customers' requests to the extent the app allows, and delete it when the shop deletes it or the shop is deleted. We do not use a shop's customer data for our own purposes beyond aggregate usage statistics.
Force majeure
Neither of us is liable for failing to perform because of events beyond reasonable control, such as outages of infrastructure providers, natural disasters, war, strikes or government action.
Governing law
These terms are governed by the laws of the developer's country of residence, and disputes are heard by its courts, without affecting mandatory consumer protections where you live. Before starting any claim, contact us at [email protected]; most issues can be settled directly.
General
These terms and the privacy policy are the whole agreement between you and us about GradeLab. If a part is found unenforceable, the rest stays in force. If we do not enforce a term, we do not waive it. You may not assign these terms; we may assign them to a successor of the business with notice. Claims must be brought within one year of the event that caused them, where the law allows. We send notices to the email address on your account; you send them to [email protected]. If these documents are translated, the English version prevails.
Changes to these terms
We will post changes here and update the date at the top. Material changes are announced in the app before they apply. Continuing to use GradeLab after that means you accept them.
